Terms of Service
Early Access version of this page. The Japanese version is the authoritative text.
Early Access. SumiCAD 0.6 and SumiCAD Cloud are an Early Access release: features may change, bugs are expected, and availability is not guaranteed. We run no extra backups of our own during Early Access, so keep your own copies of important files. A qualified architect (建築士) checks every result (Terms, Article 9).
Effective date: 24 October 2026 · Provider: Mori no Takumi Co., Ltd. (株式会社森の匠) ("we")
Please note: SumiCAD is still in development (a work in progress) and may contain errors. Every result it produces must be checked by a qualified architect (建築士), who stays responsible for the design and the permit application. See Articles 9 and 12.
1. Scope
These terms apply to the SumiCAD desktop app ("the App"), the website sumicad.com and the SumiCAD Cloud service at app.sumicad.com ("the Cloud"), together "SumiCAD".
2. Definitions
"Firm": the organisation that subscribes to the Cloud. "Owner": the person who created the Firm and manages its subscription. "Editor", "viewer", "client": the roles a Firm gives to people in the Cloud. "Content": drawings, models, files, comments and other data you put into SumiCAD.
3. Accounts
The Cloud uses an account identified by an e-mail address and one-time codes; there is no password. Keep access to your e-mail secure. You are responsible for what is done with your account. The App can be used without an account.
4. The free App
The App is provided free of charge, without a licence key. We grant you a non-exclusive, non-transferable right to install and use it, for private or business purposes. All rights in the App, including copyright, stay with Mori no Takumi Co., Ltd. You may not redistribute the App (give, sell, rent or publish copies of it), and you may not modify, reverse-engineer, decompile or disassemble it, except where the law does not allow such a ban. Third-party software included in the App is used under its own licence, shown in the App. The App is still in development and is provided as it is; Articles 9 and 12 apply to it.
5. The paid Cloud
The Cloud is a subscription per Firm. The price, the payment timing and the cancellation conditions are shown on the Pricing page, on the final confirmation screen before payment and on the Commercial Transactions Act notice. Payments are processed by Stripe.
6. Free trial
A new Firm gets a 15-day free trial. If no payment is set up by its end, the Firm becomes read-only; nothing is deleted at once.
7. Cancellation and end of the service
The Owner can cancel at any time on the subscription page. The Cloud stays available until the end of the period already paid. After the end, the Firm is read-only for 90 days so that everything can be downloaded. When the 90 days are over, the Firm's Content and the data of its members that is used only for the Firm are deleted from the Cloud, and they leave our database provider's automatic restore window within 30 days after that. Deleted data cannot be recovered, so please download what you need during the read-only period. Records that we must keep by law (for example billing records) are kept for the period the law requires (see the Privacy Policy).
8. Your Content
You keep all rights to your Content. You allow us to store, copy and transmit it only as needed to run SumiCAD for you. The Firm can download its projects and their versions at any time while it has access. During Early Access we run no extra backups of our own: the only way to restore lost or deleted data is the automatic restore window of our database provider, up to 30 days. Keep your own copies of important files ("Download .sumi" in the web app, and your local .sumi files). Weekly backups are planned for version 1.0.
9. Work in progress and professional responsibility
SumiCAD is still in development and may contain errors. It helps to prepare drawings, structural checks, building-law checks, quantities, estimates and permit documents, but these results are design aids only and do not replace professional judgement. Every result must be checked by a qualified architect (建築士) before it is used; the architect stays responsible for the design and for the permit application, and permit documents must be checked and signed by that architect. You remain responsible for the buildings you design and build, and for checking that they comply with the Building Standards Act and other laws.
10. Prohibited use
Do not break the law, infringe others' rights, try to access data you are not allowed to see, overload or attack the service, or resell the Cloud without our agreement.
11. Maintenance, changes, interruptions and end of the service
We will keep maintaining and developing SumiCAD as long as we can and as long as our funds allow, but we do not promise that it will continue for any given time. We may change, suspend or end features for maintenance, security or other reasons. We give notice in advance where reasonably possible; in an emergency (for example a security problem, a failure of a provider we depend on, or a disaster) we may have to act first and inform you afterwards. If we end the Cloud as a whole, we inform the Owners by e-mail and on the website at least 90 days in advance; until it ends, Firms can download all their data, no further fees are charged, and any fee already paid for days after the end is refunded pro rata.
12. Disclaimer and limitation of liability
- SumiCAD is provided as it is, while still in development. Except as set out in paragraphs 3 and 4, we do not guarantee that it is free of errors or interruptions, that it suits a particular purpose, or that its results comply with the Building Standards Act or other laws.
- Results made with SumiCAD (drawings, structure and law checks, quantities, estimates, permit documents and others) are design aids. Whether and how to use them is decided by you and by the architect (建築士) responsible for the design. We are not responsible for damage that arises because a result was used without being checked by a qualified architect, or for permit refusals, construction defects, delays or costs that follow from design decisions, except where the damage is caused by our intent or gross negligence.
- If we are liable to you for damage caused by our breach of contract or by a tort, and the cause is our intent or gross negligence, our liability is not limited.
- In all other cases (slight negligence), our liability is limited to direct and ordinary damage actually suffered (excluding lost profits and damage arising from special circumstances), up to the total fees the Firm paid us in the 12 months before the cause of the damage arose. Where no fee was paid (the free App, viewers, clients, the free trial), the limit is 10,000 yen.
- We are not responsible for damage that is not attributable to us, such as failures of the internet or of your devices, failures beyond our control of the providers SumiCAD depends on (payment, hosting, e-mail) or of an AI service the Firm chose, natural disasters, or Content entered by users. Please keep your own copies of important data.
- If you are a consumer under the Consumer Contract Act, nothing in these terms excludes or limits our liability beyond what that Act allows; in particular, paragraph 4 applies only to damage caused by our slight negligence, never to damage caused by our intent or gross negligence.
13. Changes to these terms
We may change these terms when the change is in the general interest of users, or when it does not go against the purpose of the contract and is reasonable in view of its necessity, the appropriateness of the new content and other circumstances (Civil Code, Article 548-4). Before the change takes effect, we publish on this page that the terms will change, the new terms and the effective date, with a reasonable period of notice (at least 30 days for a change that is unfavourable to users). Owners of paying Firms are also informed by e-mail.
14. Governing law and court
Japanese law applies. For any dispute about SumiCAD or these terms, the Sapporo Summary Court or the Sapporo District Court, according to the amount claimed, has exclusive jurisdiction in the first instance.
